1. Overview; Acceptance of Terms
These Terms govern your access to and use of our website, content, tools, products, and services (the “Services”). By using the Services, you agree to these Terms and our Privacy Policy. If you don’t agree, don’t use the Services.
2. Eligibility; Accounts
You must be the age of majority in your state of residence. You’re responsible for your account, for keeping credentials secure, and for providing accurate, complete information.

We aim to present products accurately, but on-screen appearance can vary. Descriptions, specs, and availability may change without notice. We may limit quantities or discontinue items.
4. Orders; Acceptance
Your order is an offer to purchase. We may accept or decline any order. Payment must be received and processed before acceptance. If we change or cancel an order, we’ll notify you using your provided contact details. Purchases are for personal use unless otherwise agreed in writing.
5. Prices; Taxes; Billing
Prices may change without notice; the price in your order confirmation applies. Unless stated otherwise, prices exclude shipping, handling, and taxes. You authorize us to charge your payment method for all amounts due and confirm you’re authorized to use it. Texas sales/use tax is collected where applicable. You’re responsible for additional taxes, duties, and import charges.
6. Shipping; Title; Risk of Loss
Delivery times are estimates, not guarantees. Title and risk of loss transfer to you when the carrier takes possession. We aren’t liable for carrier delays, customs processing, or events outside our control.
7. Intellectual Property
All content in the Services is owned by SMART TECHNOLOGY ENTERPRISES LLC or its licensors and protected by applicable IP laws. You may use the Services for personal, noncommercial purposes only. Don’t reproduce, distribute, or create derivative works without our prior written consent.
8. Optional Tools; Third-Party Links
You may be offered third-party tools or links. Use at your own risk and review their terms and privacy policies. We aren’t responsible for third-party content, products, or services.
9. Relationship with Platform Provider
Our store platform processes parts of the transaction, but your purchase is with SMART TECHNOLOGY ENTERPRISES LLC. The platform provider is not responsible for our sales or obligations to you.
10. Privacy
Personal information is handled per our Privacy Policy and may involve processing by our commerce and payment providers.
11. User Content; Feedback
If you submit reviews or suggestions, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use them. You represent you have the necessary rights and that your content complies with law.
12. Errors; Availability
We may correct errors, inaccuracies, or omissions and update information at any time, including after you submit an order.
13. Prohibited Uses
Don’t use the Services unlawfully; to violate rights; to transmit malware; to interfere with operations; to harvest data without permission; or to bypass security. We may suspend or terminate access for violations.

Except as expressly stated by us in writing, the Services and products are provided “as is” and “as available,” without implied warranties, including merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by Texas and U.S. law. 15. Limitation of Liability
To the fullest extent permitted by Texas law, we won’t be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or replacement costs arising from use of the Services or products. Our total liability for any claim won’t exceed the amount you paid for the product giving rise to the claim.
16. Indemnification
You agree to indemnify and hold harmless SMART TECHNOLOGY ENTERPRISES LLC and its affiliates, officers, employees, and agents from claims arising out of your breach of these Terms or violation of law or third-party rights.
17. Export; Sanctions
You agree to comply with U.S. export, re-export, and sanctions laws and not to use products in prohibited end-uses or export to restricted destinations or parties.
18. Force Majeure
We aren’t liable for delays or failure to perform due to events beyond our reasonable control, including natural disasters, labor disputes, war, governmental actions, supply shortages, or internet outages.
19. Governing Law; Venue; Dispute Resolution
These Terms are governed by Texas law and applicable U.S. federal law. Exclusive venue and jurisdiction lie in the state or federal courts located in Walker County, Texas. Each party waives objections to venue and personal jurisdiction there. If we mutually agree in writing, disputes may be resolved by binding arbitration under the Federal Arbitration Act.
20. Severability; Waiver; Assignment; Entire Agreement; Updates
If any provision is unenforceable, the rest remains in effect. Our failure to enforce isn’t a waiver. You can’t assign these Terms without our written consent; we can assign without notice. These Terms plus referenced policies are the entire agreement. We may update Terms by posting changes; continued use after the effective date means you accept the updates.
